Florida and Allstate File Briefs
The State of Florida and Allstate filed their briefing with the First District Court of Appeals. The Florida Office of Insurance filed an Amended Administrative Complaint and Allstate filed its Initial Brief of the Appellants on Friday.
On January 16, 2008, the Florida Office of Insurance suspended Allstate's right to do business in Florida after it claimed Allstate refused to comply with subpoenas issued to the company. The company sought relief from the First District Court of Appeals. The Court suspended the suspension, but demanded accelerated briefing by the parties.
At stake is Allstate's ability to write and produce both personal and business insurance in Florida. Current policies are not affected. But, if the Court finds the FOIR was entitled to suspend Allstate, the suspension will be reinstated until Allstate complies with the subpoenas to the company to the satisfaction of the insurance commissioner.
